Tony Lo Successfully Obtained Judgment for the Plaintiff in an Unjust Enrichment Claim
In Li Jia Heng v Golden World Motors (International) Limited [2024] HKDC 888, the court ruled in favour of the plaintiff’s unjust enrichment claim against the defendant for a deposit paid for a non-delivered Toyota Alphard. The defendant claimed the deposit was mistakenly applied to another customer’s purchase due to a fraudulent salesman. However, the court found that the defendant failed to prove it had actually delivered the vehicle to the other customer, thus failing to establish the essential factual premise of its intended defences of change of position and/or bona fide purchaser.
